Our service includes visitor tracking, referral code management, customer data collection, conversion tracking, and automated email delivery to your customers.

2. Data Collection and Usage

By using our service, you acknowledge and agree that we collect and process the following data:

• Visitor tracking data (visitor IDs, session IDs, page views, referral clicks)
• Customer information (email addresses, referral codes, enrollment data)
• Conversion data (purchase information, order IDs, conversion values)
• Website analytics (page URLs, referrer information, user agents)
• Metadata associated with tracking events

This data is collected through our JavaScript tracking widget and stored securely in our database. We use this data solely to provide our referral tracking services to you.

3. Email Delivery Service

Our platform sends automated emails to your customers on your behalf, including:

• Referral program invitation emails
• Reward notification emails
• Voucher code delivery emails
• Other transactional emails related to your referral program

You are responsible for ensuring you have proper consent from your customers to send these emails and that your email content complies with applicable laws, including CAN-SPAM, GDPR, and other email marketing regulations. We use Resend as our email delivery service provider.

4. User Responsibilities

• You must provide accurate information when creating your account
• You are responsible for maintaining the security of your account credentials
• You must comply with all applicable laws and regulations regarding data collection and email marketing
• You must obtain proper consent from your customers before collecting their data or sending them emails
• You are responsible for the content of emails sent through our platform
• You must not use our service for any illegal or unauthorized purpose

5. Service Limitations

While we strive to provide reliable service, we do not guarantee:

• Uninterrupted or error-free service
• 100% accuracy of tracking data
• Delivery of all emails (delivery depends on third-party email providers)
• Compatibility with all websites or platforms

6. Payment Terms

Our service offers both free and paid plans. For paid plans:

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We reserve the right to change pricing with 30 days notice
• Failure to pay may result in suspension or termination of your account

7. Account Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the service will be immediately suspended
• You may request deletion of your data within 30 days of termination
• We reserve the right to delete your data after 30 days
• Outstanding fees remain due and payable

8. Intellectual Property

All content, features, and functionality of our service are owned by Mouthfully and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of our service without our written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any material changes via email or through our service. Your continued use of the service after such changes constitutes acceptance of the new terms.
